The Summer House Noosa Heads
This Short-Term Rental Agreement (the “Agreement”) is made by and between Daniel Clifford (“Homeowner”) and the Guest(s) referred to in the email. This agreement is sent with (“Guest”) as of the date Guest accepts the terms of this agreement.
Making a payment to Homeowner to book the property constitutes acceptance of the terms of this agreement. For good and valuable consideration, the parties agree as follows:
1. Property. The property is located at: – 31 The Quarterdeck Noosa Heads QLD Australia. The property is air-conditioned and furnished and includes a refrigerator/freezer, wine fridge, rangehood, oven, microwave, coffee maker, dishwasher, fireplace, pool, outdoor shower, stacked washer and dryer, linens, towels, BBQ, cooking and serving utensils, and portable cot (on request.) Internet service with WIFI is provided.
2. Rental Party: The rental party shall consist of the Guest and the additional persons approved by Homeowner in email or other written correspondence between Homeowner and Guest. The Guest and credit card holder must be 30 years of age or older to reserve and book the property, physically stay in the house, and be responsible and courteous when occupying the property; it is Homeowner’s family beach home. We do not welcome school leavers or Bucks/ Hens parties.
3. Maximum Occupancy: The maximum number of guests is limited to 8 persons.
4. Term of the Lease. The lease begins at 3:00 p.m. on the check-in date outlined in the email this Agreement is sent with (the “Check-in Date”) and ends at 11:00 a.m. on the check-out date outlined in the email this agreement is sent with (the “Check-out Date”). Timely checkout is strictly enforced so that Homeowner’s staff have adequate time to prepare the property for the next guest, perform maintenance, etc. Guests will follow the checkout procedures documented in the departure checklist below. Guests that do not vacate the rental property by 11:00 a.m. without the Homeowner’s consent after the check-out time will be charged $100 for each half-hour increment that guest and their belongings are still occupying the house and required to vacate immediately. If nobody is checking in the day Guest checks out, and no deep cleaning or maintenance is needed, late check-outs can occasionally be arranged for a $ 200-day fee paid to Homeowner – if desired, contact Helen on 0416224330
5. Rental Rules: Guest agrees to abide by the Rental House Rules below as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the Rental Rules at all times while at the property.
6. Access: Guest shall allow Homeowner or Homeowner’s agents access to the property for repair and inspection or if Homeowner wishes to retrieve any of his personal property. The homeowner shall exercise this right of access in a reasonable manner.
7. Damages, Rental Rate, and Fees: A $500 deposit is collected to offset possible accidental damages. Please respect the property as you would your own. We do not charge for minor items such as broken glass, but we appreciate it if you let us know so we can order a replacement if something breaks or quits working. You will be billed for:
- Damage to the property or furnishings caused by intentional conduct, gross negligence, or any violation of house
- Dirt or other mess requiring excessive cleaning
- Any other extraordinary cost incurred by the Homeowner due to the Guest’s stay.

8. Rental Rate and fees. Payment in full of the following fees shall be due at least 30 days in advance of the Check-in Date: Rental rate and fees are as follows: The rental fees are outlined in correspondence done through the booking platform (e.g. Airbnb or VRBO Stayz). Rates and availability are subject to change until the reservation is confirmed.
9. Cancellation/Refund Policy: Because the home is nearly 100% booked, the owner has opted for the “Super Strict 60 days: 50% refund up until 60 days before arrival” policy. Rent/Accommodation fees (the nightly rate) are 50% refundable up until 3p.m. QLD time 60 days before the check-in date, with no refund of rent for cancellations less than 60 days in advance. If the Guest arrives late or leaves early, the nights not spent at the house are not refunded.
Cleaning fees are always refunded if the reservation is cancelled before check-in. Guests are encouraged to consider purchasing trip cancellation insurance. Please don’t book unless you can fully commit.
10. Payment: Payments should be made through the Airbnb / VRBO Stayz portal for bookings initiated through Airbnb.
Rental Rules
- No smoking in the house. You are permitted to smoke outside on the verandahs.
- Rubbish – to be taken out to the red and yellow bins and left out on the curbside on Wednesday nights for Thursday morning collection. Please then return the wheely bins in after collection.
- Strictly no pets.
- Strictly no parties.
- People other than those in the Guest party disclosed to the Homeowner in written correspondence may not stay overnight on the property.
- Any other person on the property is the sole responsibility of the Guest. The property is located in a residential area.
- Failure to comply with local Noosa government regulations concerning loud or inappropriate behaviour could result in additional charges and fines or possible eviction with no refund. Please understand we are fined by the council $1000 for excessive noise, and neighbours report us. Please move inside the house at 8 pm and be mindful of your noise (raised voices and music) and poolside, including children.
- Two vehicles can be parked in the driveway but not over it, blocking access to neighbours.
- The property is privately owned; the owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities.
- The Homeowner is not responsible for the guest’s loss of personal belongings or valuables.
- Do not remove anything from the house, soft furnishing, linens etc. and return beach towels.
- By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
Departure List
- Leaving the property in a good state of cleanliness is required upon departure. While there is a cleaning charge, In the event of the need for more extensive cleaning (i.e. stains on the carpet, bbq), you will be charged.
- Check to make sure all personal property is removed from the property, especially things such as phone chargers. We cannot be responsible for items left on the property.
- Take the rubbish out to wheely bins, both the recycles bin in the pantry and the general garbage under the sink.
- Clean BBQ and place cover on
- Turn off all fans and air-don
- Check the house is locked and return the key to the lockbox
